Having a registered agent is required in almost every state. A registered agent provides a physical address where your business can receive service of process, legal notices, and official correspondence from the state. InCorp also helps you stay informed about important compliance deadlines to keep your business in good standing while providing an additional layer of privacy by allowing your registered agent's address to be used where permitted by state law.
Your company's domestic state is the state where it was originally formed. Once your business is legally established in that state, it may register to do business in other states. In those states, your business is considered a foreign entity and must typically obtain a foreign qualification before conducting business there.
A New entity is one that has not yet been filed in the state where you're ordering registered agent service. Even if your business already exists in its domestic state, it is considered New if you haven't yet registered or qualified to do business in the state where you're placing your order.
An Existing entity is one that is already filed in the state where you're ordering service. If you're changing your registered agent to InCorp for that state, select Existing.
No. When you order Registered Agent Service only, InCorp does not automatically form your business, register it in a new state, or change your existing registered agent.
Business formation, foreign qualification, and registered agent changes are separate services. If you need any of these filings, we're happy to prepare and submit them for you once the appropriate service has been purchased.
For states that require a registered agent consent form, our order processing team will provide the necessary documents. If you're changing your registered agent to InCorp, we're also happy to assist with the required Registered Agent Change forms at no additional charge.
In most cases, yes. However, your business must also be registered with the Secretary of State in the applicable state.
Some agencies have additional requirements that we may not be able to meet, such as requiring a registered agent with an address in a specific county or requiring an individual rather than a company to serve as the registered agent.
If you're unsure whether we can meet your agency's requirements, send us the document and we'll review it to determine if InCorp can serve as your registered agent.
To obtain InCorp's signature, you must first order Registered Agent Service. Once your order is complete and you've received your confirmation email, contact our Order Processing team to begin the signature process.
The required process depends on your state's filing requirements:
- Electronic or scanned signature accepted: Reply to your order confirmation email with the completed document attached. We'll sign it and return it to you by email.
- Original signature required: Email us the document, and we'll sign and mail it back to you for filing. You may also mail us the complete filing package, including the required state payment, and we'll sign the documents and forward the package to the state on your behalf.
- Registered Agent Consent form required: Some states, such as Wyoming, require a separate Registered Agent Consent form. We'll provide the required form after your order has been placed.

No. InCorp provides registered agent services for businesses and other entities registered with the Secretary of State.
If you need a registered agent for an individual rather than a business entity, we recommend consulting an attorney or law office.
